The focus of the Nevada and Massachusetts laws are on account information. In particular for lawyers are social security numbers and credit card numbers.

If you accept credit cards for payment, then you need to make sure that you destroy the numbers after the transaction goes through and you need to make sure that your provider is fully compliant.

Lawyers using social security numbers are mostly TandE and bankruptcy lawyers. It is up to the lawyers to be more careful about these. Scanning and email are going to be bad choices for transmitting those.

Personally, I think you are going too far by moving away from email for all client communication. Ultimately it is just as safe as postage. That is to say not secure, but it is a crime to intercept it.
